[00:02:22] This is the final episode of this season of Serial Nightmare, a Halloween series that I do every year for the month of October.

[00:02:30] So everything that I've released this month has been Halloween-related or more on the spooky side, but of course, always true crime.

[00:02:38] In the mid-1980s, Christina Boyer captivated the nation as a teenager with an extraordinary claim, that she could move objects with her mind.

[00:02:49] Known as the Columbus Poltergeist Kid, her family's insistence on her powers catapulted her to media stardom, even earning her a spot in an Unsolved Mysteries episode.

[00:03:01] But just as quickly as she rose to fame, her life spiraled out of control, first as a runaway teen, then as a single mother and a domestic violence survivor.

[00:03:14] However, no one could have predicted the tragic events that happened in 1992, when Christina was arrested for the unthinkable, charged with the murder of her three-year-old daughter, Amber.

[00:03:26] Though she insisted that she was innocent, when faced with the death penalty, she opted for an Alford plea, admitting no guilt while accepting a life sentence plus 20 years in prison.

[00:03:39] Yet the most perplexing aspect of her case lies in the evidence.

[00:03:45] How could she be guilty of murdering her own child when she wasn't even home during the critical hours leading up to Amber's death?

[00:03:52] That's the question Christina and her supporters would like an answer to, amidst a tangled web of legal battles.

[00:04:01] So, dim the lights, put your phone down, and listen to the story of Christina Boyer, once dubbed the Columbus Poltergeist Kid, now sitting behind bars in a desperate fight to reclaim her innocence.

[00:04:14] So, let's jump right in.

[00:04:17] Christina Boyer was born from humble beginnings on October 23, 1969, to a mother who simply could not take care of her.

[00:04:26] When she was just a baby, her biological mother struggled so desperately with her drug addiction that she dropped her off at a nearby hospital and never returned for her.

[00:04:36] Christina was placed into foster care and then moved into the home of Joan and John Raich, who had previously fostered as many as 250 children.

[00:04:47] At times, there were up to six foster children in their care, in addition to their own children.

[00:04:53] When Christina was two and a half years old, the Raiches adopted her.

[00:04:58] Though she's been described as a bubbly child, she struggled in the formal setting of a classroom.

[00:05:04] Her teachers reported that, at times, she would have these outbursts where she would throw erasers and pencils, disrupting the lesson.

[00:05:13] At just eight years old, she was diagnosed as hyperactive.

[00:05:18] But to her classmates, she just came across as different from them.

[00:05:22] And she was teased relentlessly.

[00:05:26] Christina's doctors prescribed her medication to help ease some of the behavioral issues.

[00:05:30] And it certainly helped.

[00:05:32] However, due to the awful bullying, she was pulled out of the public school and was homeschooled instead.

[00:05:39] Being able to complete her work at home with the help of a tutor seemed to do the trick.

[00:05:44] Because Christina, she started to thrive in this new setting.

[00:05:48] However, it did make it difficult for her to make other childhood friends.

[00:05:52] Instead, she spent much of her time in the house.

[00:05:55] The Raich home became her own personal prison, where she felt unsafe.

[00:06:02] Because at just 12 years old, she reported that her foster brother had been molesting her.

[00:06:08] Sadly, Joan and John, they didn't believe her.

[00:06:12] Or maybe they just didn't want to hear it.

[00:06:14] Because according to Christina, after telling them what was happening to her,

[00:06:18] she was promptly slapped in the face.

[00:06:20] And it was never spoken about again.

[00:06:22] A few years later, strange occurrences began to happen in the Raich household.

[00:06:28] All of which seemed to be connected to Christina.

[00:06:31] On one occasion, Joan was in the kitchen washing the dishes,

[00:06:35] when suddenly the lights began to flick on and off, seemingly by themselves.

[00:06:41] She looked at the clock, and its hands were spinning around the face.

[00:06:46] Suddenly, several electrical appliances around the house just turned on,

[00:06:50] including the TV, the garbage disposal, and the washing machine.

[00:06:54] At first, Joan thought that Christina, who was in the same room,

[00:06:59] was possibly playing a prank on her.

[00:07:01] But when it became clear that she had not been behind it,

[00:07:04] the next thought was that it had to be some kind of electrical power surge.

[00:07:10] John Raich called an electrician over to the home to find out what was going on.

[00:07:14] But the electrician couldn't identify any specific reason behind the appliances suddenly powering on.

[00:07:20] The breakers were operating just fine.

[00:07:23] There didn't appear to be any hot spots in the house,

[00:07:26] nothing that could reasonably explain what Joan had experienced.

[00:07:31] But that wasn't the end of it.

[00:07:34] Later on in the day,

[00:07:35] John was feeding one of the younger children in her high chair,

[00:07:38] when suddenly, it began to move all by itself.

[00:07:42] Then, Tina fell to the floor.

[00:07:45] It looked like she had been pushed out of the chair that she was sitting in.

[00:07:49] And then a moment later,

[00:07:50] a glass appeared to be thrown across the room.

[00:07:53] Other items, like coasters, would also be thrown about the room.

[00:07:57] The chaotic scene only stopped when Tina left the home,

[00:08:01] going out for a walk to clear her head.

[00:08:04] So, was Tina the source of whatever paranormal activity was happening in the home?

[00:08:09] The deeply religious rashes believed so.

[00:08:14] Actually, they thought that Tina may have been possessed by a demon.

[00:08:18] Perhaps that was also the cause of her outbursts at school.

[00:08:22] So, they called a minister to cleanse their home

[00:08:25] of whatever evil spirit was wreaking havoc in their lives.

[00:08:28] This minister allegedly tried to cleanse both Tina and the house.

[00:08:33] But, when he was attacked by having a couch pushed into his leg,

[00:08:38] he told them that there was nothing further he could do to help,

[00:08:41] and he just left.

[00:08:42] But the poltergeist activity, it continued.

[00:08:45] The rashes called a local reporter named Mike Hardin

[00:08:49] from the Columbus Dispatch to come to the home

[00:08:51] and do a story on what was happening.

[00:08:54] Mike brought with him photographer Fred Shannon,

[00:08:56] and as they all sat in the family home living room,

[00:09:00] strange things began to happen once again.

[00:09:03] Allegedly, a framed picture that Christina was holding in her hands,

[00:09:07] it suddenly shattered.

[00:09:09] The glass on it just broke.

[00:09:12] And a lamp?

[00:09:13] It flew off a side table that was right next to her.

[00:09:16] But the most famous occurrence, which was photographed by Fred,

[00:09:20] was when the receiver of a telephone appeared to fly up in the air across Christina's lap.

[00:09:27] This photo was positioned as absolute proof

[00:09:30] that there was some paranormal poltergeist activity happening in the home

[00:09:34] connected to Christina,

[00:09:36] because things only seemed to happen while Christina was there.

[00:09:39] Now, you're going to have to let me know what you think of the photo,

[00:09:43] because some see it as definitive proof,

[00:09:45] while others think that it looks like Christina could have been the one to throw it.

[00:09:56] Either way, when this photo hit the news,

[00:09:59] Christina became an overnight media sensation,

[00:10:02] with reporters flocking to their home,

[00:10:05] hoping to catch a glimpse of the paranormal activity themselves.

[00:10:09] This is when one reporter allegedly caught Christina in a hoax.

[00:10:14] She had been seen pulling a lampshade,

[00:10:17] knocking the lamp off of the table.

[00:10:19] According to media outlet UPI,

[00:10:22] quote,

[00:10:23] When the videotape was examined later,

[00:10:25] it showed Tina waiting until no one was watching,

[00:10:28] and then she reached up and pulled a table lamp toward herself,

[00:10:33] simultaneously jumping away and making a series of bleeding noises

[00:10:37] as she acted terrified.

[00:10:39] When confronted about it,

[00:10:41] she claimed that the reporter said that they weren't going to be leaving

[00:10:44] until they had witnessed something paranormal,

[00:10:46] and she just wanted them all gone.

[00:10:49] So, she decided to knock over the lamp herself and blame it on the poltergeist.

[00:10:54] Some people believed this explanation,

[00:10:57] while others thought that it had probably been a hoax all along.

[00:11:02] Maybe she had just been desperately wanting attention,

[00:11:06] especially after not being believed about her foster brother,

[00:11:09] but I'll let you decide what you think.

[00:11:12] A parapsychologist by the name of Dr. William Roll

[00:11:16] continued to take an interest in Christina's story,

[00:11:18] and he wanted to study her.

[00:11:21] He visited her in her home,

[00:11:23] following her around with a camcorder and a voice recorder,

[00:11:27] and while during the first three days there wasn't any kind of paranormal activity,

[00:11:32] on the fourth day,

[00:11:34] he reported seeing a mug being thrown across the room

[00:11:37] while sitting down with Christina in her bedroom.

[00:11:40] And now, he was a believer.

[00:11:43] Dr. Roll invited Christina to stay at his home in North Carolina

[00:11:47] so that he could investigate the source of these mysterious events further.

[00:11:52] He believed that Christina was susceptible to electrical energy,

[00:11:57] allowing her to manipulate the physical environment around her,

[00:12:01] and he wanted to know why.

[00:12:03] This is where he introduced Christina to psychiatrist and hypnotherapist,

[00:12:08] Jeannie Legel,

[00:12:09] who was going to be helping with the study.

[00:12:12] Together, they used a combination of interviews,

[00:12:15] brain scans,

[00:12:16] and hypnotherapy to dig deeper into what was going on with Christina.

[00:12:20] They had not yet finished their research

[00:12:22] when Christina decided that it was time to return home

[00:12:25] to her foster parents, Joan and John.

[00:12:28] But it wasn't the happy welcoming that she had hoped for.

[00:12:33] Christina alleges that there was abuse,

[00:12:36] causing her to run away at just 16 years old

[00:12:39] with a much older man named James Bennett.

[00:12:42] Christina and James, they got married,

[00:12:45] meaning she would never have to return to the Raish's household again.

[00:12:49] But this didn't mean freedom for her.

[00:12:52] James was both physically and mentally abusive to Christina,

[00:12:56] often beating her and destroying her belongings.

[00:12:59] When she tried to get away from him,

[00:13:01] he would always track her down and bring her back,

[00:13:04] and each time the abuse would get even worse.

[00:13:09] Eventually, she was able to successfully get away from her husband,

[00:13:12] and she moved in with a roommate.

[00:13:15] However, James continued to stalk and harass her,

[00:13:19] causing her to spiral downward into a depressive state.

[00:13:22] At one point, she was so physically sick,

[00:13:26] constantly throwing up,

[00:13:28] and severely dehydrated,

[00:13:29] so she went to the hospital,

[00:13:31] and this is when she discovered that

[00:13:33] she was pregnant with James' baby.

[00:13:36] At just 19 years old,

[00:13:39] Christina gave birth to a baby girl named Amber Gail Bennett

[00:13:42] in September of 1988.

[00:13:45] It was not easy.

[00:13:46] It was a struggle.

[00:13:48] She didn't have any kind of support system in place,

[00:13:51] and her husband continued stalking her,

[00:13:53] even making bogus claims

[00:13:55] to Franklin County Children's Services, FCCS.

[00:13:58] At first, he refused to sign divorce papers,

[00:14:03] but eventually, in 1990,

[00:14:05] Christina was able to finally get that divorce

[00:14:08] that she so desperately wanted.

[00:14:11] She moved on,

[00:14:12] and she entered a second marriage,

[00:14:14] which was brief,

[00:14:16] because he too was physically abusive towards her.

[00:14:19] Though Christina says that

[00:14:20] he never laid a hand on baby Amber,

[00:14:23] she was worried that the state

[00:14:25] might try to take her daughter away

[00:14:27] if they learned that she was living in this

[00:14:29] tumultuous home life.

[00:14:31] She didn't want her child to suffer the same fate as she did,

[00:14:35] being placed into foster care,

[00:14:37] growing up never knowing her real mother.

[00:14:39] So, one night,

[00:14:41] while her second husband was sitting behind bars,

[00:14:44] she packed her suitcase up,

[00:14:46] and she and Amber,

[00:14:47] they left for Georgia,

[00:14:49] where parapsychologists

[00:14:51] Bill Roll and Jeannie Legle lived.

[00:14:53] They were both happy to take Christina and her daughter in

[00:14:56] during their time of need.

[00:14:58] They helped her to get her own place,

[00:15:00] get on the food stamps program,

[00:15:02] and Jeannie offered her part-time employment,

[00:15:05] transcribing notes.

[00:15:07] Christina also began taking parenting classes,

[00:15:10] and she signed up for several college courses.

[00:15:13] She would say,

[00:15:14] I was actually proud of myself.

[00:15:17] I was on my own for the most part.

[00:15:19] I had gotten us away from my ex-husband,

[00:15:21] and I was making it.

[00:15:24] I had begun taking parenting classes at the local tech college,

[00:15:27] and begun classes to brush up on my math skills.

[00:15:31] I thought I was doing alright.

[00:17:31] While she was on food stamps and earning a small amount of money working for Jeannie,

[00:17:36] she still struggled to pay her bills and afford Christmas presents for her daughter.

[00:17:42] She desperately wanted to find meaningful employment,

[00:17:45] but she couldn't afford daycare without a job,

[00:17:48] and she couldn't get a job without daycare for Amber.

[00:17:51] However, she would meet a man named David Heron,

[00:17:55] who was also a single father,

[00:17:57] and he offered to help Christina out by watching little Amber while she worked

[00:18:02] and tried to find a better job.

[00:18:04] David's daughter Ashley was about the same age as Amber,

[00:18:08] so it seemed to work out perfectly.

[00:18:11] Yet not everything was as perfect as it was supposed to be.

[00:18:15] Christina began to notice that after picking up Amber from David's care,

[00:18:19] she would have mysterious bruises on her body.

[00:18:24] According to Christina,

[00:18:25] Amber was quite a bit more hyperactive than David's daughter Ashley,

[00:18:30] and he didn't quite seem to know how to handle her.

[00:18:33] But David always explained the bruising away as an accident.

[00:18:37] Amber was running around, tripping and falling, hurting herself.

[00:18:42] Christina knew that Amber could be rambunctious,

[00:18:45] so she didn't really think much more of it at the time.

[00:18:48] But everything would change on April 14, 1992.

[00:18:53] That day, Christina left Amber with David

[00:18:56] so that she could go to work for Jeannie transcribing notes.

[00:18:59] She worked for about six hours,

[00:19:01] and then she returned back home to David's.

[00:19:04] When she arrived,

[00:19:06] David was already standing outside the trailer.

[00:19:09] As Christina got out of the car,

[00:19:11] David told her that he couldn't wake Amber up from her nap.

[00:19:15] Christina ran to Amber,

[00:19:17] and she found her three-year-old daughter limp and unconscious.

[00:19:21] The two got back into the car to rush to the hospital

[00:19:24] while Christina tried to perform CPR on the little girl.

[00:19:27] When they arrived,

[00:19:29] Amber was quickly wheeled into an operating room

[00:19:32] where she was sadly pronounced dead.

[00:19:35] It was immediately suspected that her death

[00:19:38] was as a result of child abuse.

[00:19:40] On April 14, 1992,

[00:19:43] I left Amber alone with David

[00:19:45] as I went to work for six hours

[00:19:47] with my therapist, Jeannie L'Engle Dollar.

[00:19:50] I came home, and Amber was deceased.

[00:19:52] In the days leading up to that,

[00:19:54] as I would come home,

[00:19:55] Amber would increasingly have more bruises.

[00:19:58] When I questioned Amber about it,

[00:19:59] she would tell me that she had fallen.

[00:20:02] David had told me that she had fallen,

[00:20:04] and I believed her because Amber was rambunctious

[00:20:06] and usually got bruises all the time.

[00:20:10] The day that I got home,

[00:20:11] Amber had significantly more bruises on her.

[00:20:14] When I asked David what was going on,

[00:20:15] what happened to her?

[00:20:16] Why does she look like this?

[00:20:17] David just kept saying,

[00:20:18] I'm sorry, I'm sorry.

[00:20:21] I did not kill my daughter.

[00:20:23] I didn't beat her.

[00:20:24] I never beat her.

[00:20:26] Yes, I spanked her, but I never beat her.

[00:20:28] I never left marks on her.

[00:20:30] I had no reason to believe

[00:20:31] that that would be the last day

[00:20:33] that I would ever see her alive again.

[00:20:36] Both Christina Boyer and David Heron

[00:20:40] were immediately arrested

[00:20:41] and taken from the hospital

[00:20:43] to the police station

[00:20:44] to be questioned individually.

[00:20:46] Christina's interview was not video

[00:20:48] or audio recorded.

[00:20:50] Instead, notes were taken down by hand.

[00:20:53] Investigators allegedly told her

[00:20:55] that Amber had several large bruises

[00:20:57] on her body,

[00:20:58] and Christina let them know

[00:20:59] that the little girl was notorious

[00:21:01] for falling and injuring herself.

[00:21:04] Investigators also asked Christina

[00:21:06] if David had ever sexually abused Amber,

[00:21:09] which she said no to.

[00:21:11] But their questioning,

[00:21:12] it led her to believe

[00:21:14] that maybe there was evidence

[00:21:16] that he had.

[00:21:17] According to Christina,

[00:21:19] the police told her that

[00:21:20] they believed David had murdered Amber,

[00:21:22] and she needed to come clean

[00:21:24] about everything that she knew,

[00:21:26] because by refusing to cooperate

[00:21:28] with the investigation against him,

[00:21:30] she was protecting her daughter's killer.

[00:21:32] Meanwhile,

[00:21:33] in another interview room,

[00:21:35] the police were questioning David.

[00:21:37] His interview was taped.

[00:21:40] David claimed that

[00:21:41] he had never hit Amber

[00:21:42] other than the rare occasion

[00:21:44] when he would spank her on her bottom.

[00:21:47] And he wasn't the only one

[00:21:49] who spanked Amber.

[00:21:50] He said that Christina

[00:21:51] did it on occasion too.

[00:21:53] However,

[00:21:54] on the day in question,

[00:21:55] Christina had been at work

[00:21:57] for six hours

[00:21:58] prior to Amber's death,

[00:21:59] and David,

[00:22:00] he was the only adult

[00:22:01] in the child's presence.

[00:22:03] Other than that,

[00:22:04] David claimed that

[00:22:05] Amber had a goose egg

[00:22:07] on her forehead

[00:22:07] after tripping

[00:22:08] on a sidewalk curb.

[00:22:25] at the hospital.

[00:22:26] But Christina

[00:22:28] didn't want to,

[00:22:29] because she was afraid

[00:22:30] that Child Protective Services

[00:22:32] would remove her daughter

[00:22:33] from her custody.

[00:22:34] But according to Christina,

[00:22:36] it was the exact opposite.

[00:22:38] She had said to David

[00:22:40] that she wanted

[00:22:41] to bring Amber

[00:22:41] to the hospital

[00:22:42] on multiple occasions.

[00:22:44] But David claimed

[00:22:45] that they would

[00:22:46] take her daughter

[00:22:46] away from her,

[00:22:47] so she was terrified

[00:22:49] of that happening,

[00:22:49] so she didn't.

[00:22:51] Police allegedly

[00:22:52] also told David

[00:22:54] that there was evidence

[00:22:55] that Amber

[00:22:55] had been sexually abused

[00:22:57] and that if he were

[00:22:58] to come clean

[00:22:59] about that,

[00:23:00] then his sentence

[00:23:01] would likely be more

[00:23:02] lenient.

[00:23:03] Eventually,

[00:23:04] David did admit

[00:23:05] to the sexual abuse,

[00:23:06] saying he did it twice,

[00:23:08] though towards

[00:23:08] the end of the interview,

[00:23:10] he would recant

[00:23:10] that statement altogether,

[00:23:11] saying that

[00:23:12] he never sexually abused her,

[00:23:14] he never murdered her.

[00:23:15] An autopsy revealed

[00:23:17] that Amber had died

[00:23:18] from blunt force trauma

[00:23:19] to the head.

[00:23:20] She also had

[00:23:21] multiple bruises

[00:23:22] on her body

[00:23:22] at the time of her death,

[00:23:24] including a large bruise

[00:23:25] on her face.

[00:23:27] Some of her injuries

[00:23:28] were new

[00:23:29] and some were older,

[00:23:31] but it was clear

[00:23:32] that the little girl

[00:23:33] had been physically abused

[00:23:34] for some time now.

[00:23:36] However,

[00:23:37] the fatal blow

[00:23:38] to the head

[00:23:38] would have happened

[00:23:40] during the time

[00:23:40] when Christina

[00:23:41] was at work

[00:23:42] and she was in David's care.

[00:23:44] Both Christina

[00:23:45] and David

[00:23:46] were charged

[00:23:46] with murder

[00:23:47] and cruelty to children.

[00:23:49] While investigators

[00:23:50] weren't sure

[00:23:50] which of them

[00:23:51] had dealt

[00:23:52] the fatal blow,

[00:23:53] they believed

[00:23:54] that both

[00:23:55] were guilty

[00:23:55] of at least something,

[00:23:57] including

[00:23:57] not calling 911

[00:23:59] after the little girl

[00:24:00] was discovered unconscious.

[00:24:02] One detective

[00:24:03] would later say,

[00:24:04] quote,

[00:24:04] One of the two

[00:24:05] had to do it.

[00:24:06] They were pointing

[00:24:07] at each other,

[00:24:08] but they were

[00:24:08] the only two,

[00:24:09] so we charged

[00:24:10] both of them.

[00:24:12] While Christina

[00:24:12] was allowed

[00:24:13] to visit the funeral home

[00:24:15] to see her daughter

[00:24:16] in her casket,

[00:24:17] she wasn't allowed

[00:24:19] to attend the funeral.

[00:24:20] And I guess

[00:24:21] I understand it.

[00:24:23] However,

[00:24:23] at this point,

[00:24:24] Christina

[00:24:25] is innocent

[00:24:25] until proven guilty.

[00:24:26] She hasn't gone

[00:24:27] to trial yet.

[00:24:28] And to deny

[00:24:29] a mother

[00:24:30] the ability

[00:24:31] to attend

[00:24:31] her baby girl's

[00:24:32] funeral,

[00:24:33] it seems cruel.

[00:24:35] I don't know

[00:24:35] what the correct answer

[00:24:36] is here,

[00:24:37] because obviously

[00:24:38] if a mother

[00:24:38] kills her child,

[00:24:39] if it is proven

[00:24:40] that she has

[00:24:41] killed her child,

[00:24:41] she shouldn't

[00:24:42] ever be allowed

[00:24:43] to attend the funeral.

[00:24:44] But at this point,

[00:24:46] there's no clear

[00:24:46] answer to that.

[00:24:48] Amber was buried

[00:24:49] in her Easter dress

[00:24:50] and her casket

[00:24:51] was filled

[00:24:52] with stuffed animals.

[00:24:53] Now,

[00:24:54] let's talk about

[00:24:55] some of the evidence

[00:24:55] in the case

[00:24:56] against both

[00:24:57] Christina and David.

[00:24:58] The police would

[00:24:59] raid both of their homes

[00:25:01] looking for anything

[00:25:02] that might be helpful

[00:25:03] at trial.

[00:25:04] At Christina's apartment,

[00:25:06] they found a belt,

[00:25:07] which they believed

[00:25:08] may have been used

[00:25:09] to beat Amber,

[00:25:10] including causing

[00:25:11] the big bruise

[00:25:12] that was on her face

[00:25:13] because it was

[00:25:14] roughly the same

[00:25:15] size and shape.

[00:25:17] However,

[00:25:17] the belt

[00:25:18] was never tested

[00:25:19] for DNA,

[00:25:20] so it was

[00:25:21] just a guess.

[00:25:22] As for David's trailer,

[00:25:24] they found bloody

[00:25:25] tissues in the garbage

[00:25:26] can which matched

[00:25:27] Amber's blood type.

[00:25:29] David claimed

[00:25:30] that the tissues,

[00:25:31] they were used

[00:25:31] to wipe away

[00:25:32] blood that had

[00:25:33] been on her lip

[00:25:33] when a cut

[00:25:34] had reopened.

[00:25:36] And in the autopsy,

[00:25:38] multiple cuts

[00:25:38] were found

[00:25:39] on her lips

[00:25:40] and on the inside

[00:25:41] of her mouth.

[00:25:42] Then there were

[00:25:43] the character statements.

[00:25:45] Christina,

[00:25:46] she had a history

[00:25:47] with Child Protective

[00:25:48] Services being called,

[00:25:49] some of those calls

[00:25:50] which were made

[00:25:51] on behalf of her

[00:25:52] abusive ex-husband.

[00:25:53] While Christina

[00:25:54] admitted to

[00:25:55] physically disciplining

[00:25:56] her child

[00:25:57] by spanking her

[00:25:58] at times,

[00:25:59] she denied ever

[00:26:00] abusing her child.

[00:26:02] And in fact,

[00:26:03] while there were

[00:26:04] three reports

[00:26:05] of child abuse

[00:26:06] filed against Christina

[00:26:07] in Ohio

[00:26:07] at one point or another,

[00:26:09] all three were

[00:26:10] investigated

[00:26:11] and deemed

[00:26:12] unsubstantiated.

[00:26:14] This included

[00:26:15] one occasion

[00:26:15] when Amber

[00:26:16] was brought

[00:26:17] into the hospital

[00:26:17] with severe

[00:26:18] diaper rash,

[00:26:20] which had turned

[00:26:21] into a staph infection

[00:26:22] because Christina

[00:26:23] had used the wrong

[00:26:25] kind of diaper cream.

[00:26:26] The hospital staff

[00:26:28] initially called

[00:26:28] Child Protective

[00:26:29] Services,

[00:26:30] believing that

[00:26:31] the little girl

[00:26:31] had been burned.

[00:26:33] However,

[00:26:34] a formal report

[00:26:35] was never filed

[00:26:36] once it became clear

[00:26:37] that it was actually

[00:26:38] a staph infection.

[00:26:40] With Christina's

[00:26:41] past

[00:26:42] being dubbed

[00:26:43] the Columbus

[00:26:43] poltergeist kid

[00:26:44] who appeared

[00:26:45] on Unsolved Mysteries,

[00:26:46] the case received

[00:26:48] much more attention

[00:26:49] than it typically

[00:26:50] would have.

[00:26:51] It also painted

[00:26:52] Christina

[00:26:52] in a negative light

[00:26:54] because of

[00:26:55] the allegations

[00:26:56] of it all

[00:26:57] being a hoax.

[00:26:58] People were kind

[00:26:59] of weirded out

[00:26:59] by it.

[00:27:00] Like,

[00:27:00] was there this

[00:27:01] paranormal experience

[00:27:02] going on?

[00:27:03] Was she possessed

[00:27:04] by a demon?

[00:27:05] Was she a witch?

[00:27:06] There were just

[00:27:07] rumors flying.

[00:27:09] She was terrified

[00:27:10] that she was

[00:27:11] going to get

[00:27:12] the death penalty.

[00:27:13] Her friends

[00:27:14] put together

[00:27:15] money to pay

[00:27:15] for her to

[00:27:16] take a polygraph

[00:27:17] test,

[00:27:17] which she passed.

[00:27:19] However,

[00:27:19] Christina's lawyer

[00:27:20] let her know

[00:27:21] that she didn't

[00:27:22] stand much

[00:27:23] of a chance

[00:27:23] in court,

[00:27:24] especially once

[00:27:25] those autopsy

[00:27:26] photos would be

[00:27:27] released at trial

[00:27:28] because the little

[00:27:30] girl looked

[00:27:31] battered and

[00:27:32] bruised.

[00:27:33] So,

[00:27:34] Christina accepted

[00:27:34] an Alford plea,

[00:27:36] which meant that

[00:27:37] while she was

[00:27:38] pleading guilty

[00:27:39] to her charges,

[00:27:40] she formally

[00:27:41] maintained her

[00:27:42] innocence.

[00:27:42] It's basically

[00:27:43] saying,

[00:27:44] I didn't do it,

[00:27:45] but I think a

[00:27:46] court is going

[00:27:47] to find me

[00:27:47] guilty anyway,

[00:27:48] so I'm taking

[00:27:49] a plea deal.

[00:27:50] In turn,

[00:27:51] she was sentenced

[00:27:51] to life in prison

[00:27:53] plus 20 years,

[00:27:54] but it meant that

[00:27:55] the death penalty

[00:27:56] was off the table.

[00:27:58] After sentencing,

[00:27:59] Christina began

[00:28:00] to question whether

[00:28:01] or not she received

[00:28:02] a fair trial.

[00:28:03] Her lawyer,

[00:28:05] Jimmy D. Berry,

[00:28:06] had a busy

[00:28:07] caseload at the

[00:28:08] time.

[00:28:08] He actually was

[00:28:09] working on 88

[00:28:11] other cases

[00:28:11] across the state

[00:28:12] of Georgia.

[00:28:13] And in fact,

[00:28:15] in the two and a

[00:28:16] half years that

[00:28:16] Christina was in

[00:28:17] jail waiting to

[00:28:18] go to trial,

[00:28:19] he had only

[00:28:19] visited her

[00:28:20] three times.

[00:28:22] According to

[00:28:23] his billable

[00:28:23] hours,

[00:28:24] he spent

[00:28:25] 108.58 hours

[00:28:27] in court

[00:28:28] and only

[00:28:29] 17.25 hours

[00:28:31] at a court

[00:28:31] working on

[00:28:32] Christina's case,

[00:28:33] which would

[00:28:33] include any visits

[00:28:34] to her in jail

[00:28:35] and any other

[00:28:37] evidence gathering.

[00:28:38] Even though

[00:28:39] the medical

[00:28:40] report,

[00:28:41] combined with

[00:28:41] her alibi,

[00:28:43] showed that

[00:28:43] Christina was

[00:28:44] not present

[00:28:44] when Amber

[00:28:45] received the

[00:28:46] injury that

[00:28:46] killed her,

[00:28:47] her lawyer

[00:28:48] convinced her

[00:28:49] that a jury

[00:28:49] would find her

[00:28:50] guilty and

[00:28:51] sentence her

[00:28:51] to death.

[00:28:52] Now,

[00:28:53] instead,

[00:28:54] she would

[00:28:55] spend life

[00:29:25] to 30 minutes

[00:29:27] would have

[00:29:27] displayed signs

[00:29:28] of brain

[00:29:28] damage,

[00:29:29] like

[00:29:30] unsteadiness,

[00:29:31] sleepiness,

[00:29:32] nausea,

[00:29:32] and vomiting.

[00:29:33] However,

[00:29:34] David always

[00:29:36] was behaving

[00:29:37] perfectly

[00:29:37] normal that

[00:29:38] morning,

[00:29:39] and she

[00:29:39] only began

[00:29:40] to act

[00:29:40] unusual

[00:29:41] about two

[00:29:42] hours after

[00:29:43] Christina

[00:29:43] left for

[00:29:44] work.

[00:29:44] The last

[00:29:45] time that

[00:29:46] Christina

[00:29:46] had been

[00:29:46] alone with

[00:29:47] Amber was

[00:29:48] approximately

[00:29:48] six days

[00:29:49] prior to

[00:29:50] her death,

[00:29:50] when the

[00:29:51] little girl

[00:29:51] seemed totally

[00:29:52] normal.

[00:29:53] The medical

[00:29:54] examiner

[00:29:55] testified that

[00:29:55] it was

[00:29:56] quote,

[00:29:56] very unlikely

[00:29:58] that the fatal

[00:29:59] blow happened

[00:29:59] as far back

[00:30:00] as then,

[00:30:01] meaning

[00:30:01] whatever

[00:30:02] injury killed

[00:30:03] Amber

[00:30:04] had happened

[00:30:05] while she

[00:30:06] was at

[00:30:08] work.

[00:30:09] However,

[00:30:10] there were

[00:30:10] many witnesses

[00:30:12] at David's

[00:30:12] trial that

[00:30:13] he was this

[00:31:07] easier,

[00:31:08] which seems

[00:31:09] like a

[00:31:09] huge injustice

[00:31:10] since all

[00:31:13] to him

[00:32:42] think so.

[00:32:43] All of the

[00:32:44] evidence points

[00:32:45] to the fact

[00:32:46] that she

[00:32:46] wasn't even

[00:32:47] there when it

[00:32:47] happened.

[00:32:49] was she

[00:32:50] possibly

[00:32:51] convicted?

[00:32:52] Well,

[00:32:53] according to

[00:32:54] the lead

[00:32:54] prosecutor in

[00:32:55] David's case,
